The firm has a particular focus on employment disputes that intersect with its First Amendment and civil rights practices. Public employees enjoy broad First Amendment protections when they engage in speech on matters of public concern. That constitutional shield, however, does not prevent employers from sidelining and even firing employees brave enough to take a stand on unpopular positions. In certain states, even private employees are protected from political discrimination. California’s Labor Code, for example, prevents employers from adopting policies that restrict political activity and from terminating employees for their political activity.
